These Terms of Service govern your use of the website, communications, and services provided by Bold & Bolder LLC, doing business as The Lugo Insurance Agency ("TLIA," "we," "us," or "our"). Please read them carefully before using our website or requesting services.

By accessing or using our website, submitting an inquiry, scheduling an appointment, requesting insurance guidance, or opting into our SMS or email programs, you acknowledge that you have read and agree to these Terms of Service and our Privacy Policy.

If you do not agree to these Terms, do not use the website or related services. You must be at least 18 years old and legally capable of entering into a binding agreement to use our services independently.

2. Insurance Information and Services

TLIA provides insurance education, guidance, quote assistance, enrollment support, and related services. Information available through the website is provided for general informational purposes and does not describe every term, limitation, exclusion, condition, or eligibility requirement that may apply.

Insurance coverage cannot be bound, issued, renewed, canceled, amended, or otherwise placed into effect through this website, an online form, voicemail, email, or SMS message. Coverage becomes effective only when confirmed by an authorized insurance carrier or appropriately licensed representative and documented in the applicable policy or official coverage materials.

Quotes and eligibility

Quotes, estimates, illustrations, plan comparisons, and preliminary eligibility information are not guarantees of price, coverage, acceptance, enrollment, or benefits. Final availability, premiums, effective dates, benefits, and coverage are determined by applicable law, carrier rules, underwriting, eligibility, enrollment periods, complete and accurate application information, and the terms of the controlling policy or plan documents.

State availability and licensing

Insurance products and services are offered only in jurisdictions where TLIA and the individuals involved are properly licensed and where the relevant products are available. Not every product, carrier, or service is available in every state or to every person.

Controlling documents

If website content, a quote, comparison, explanation, or communication differs from an insurance policy, certificate, evidence of coverage, summary of benefits and coverage, plan document, carrier contract, or other official material, the official carrier or plan document controls.

No legal, tax, or medical advice

Nothing on the website constitutes legal, tax, accounting, financial, or medical advice. You should consult an appropriately qualified professional regarding those matters.

3. Your Responsibilities and Acceptable Use

You agree to:

  • Provide information that is complete, current, and accurate.
  • Review applications, quotes, enrollment materials, policy documents, and carrier communications for accuracy.
  • Promptly notify us or the applicable carrier of errors or material changes.
  • Use the website only for lawful, personal, and legitimate business purposes.
  • Avoid submitting Social Security numbers, payment-card information, medical records, diagnoses, or other highly sensitive information through a general website form unless we provide an appropriate secure method.

You may not attempt to disrupt the website, gain unauthorized access, introduce malicious code, scrape or systematically extract content, impersonate another person, submit fraudulent information, or use the website in a manner that violates law or the rights of others.

4. SMS and Email Communications

Program description

TLIA may send SMS and email messages to individuals who request communications or provide the required consent. Messages may include appointment confirmations and reminders, responses to inquiries, application or enrollment updates, account or service notifications, educational information, and promotional messages. Message frequency may vary.

Consent

By providing your mobile number and affirmatively opting in, you authorize TLIA to send messages to that number, including messages sent through automated technology where permitted. Consent to receive marketing messages is not a condition of purchasing goods or services. Transactional and promotional consent choices may be presented separately.

Opting out

You may cancel SMS messages at any time by replying STOP. After we receive a valid STOP request, we may send one confirmation message and will stop further messages covered by the request unless you later opt in again. To rejoin, use the same method originally used to enroll or complete a new opt-in.

Email preferences

Marketing emails include an unsubscribe method. We may continue to send non-promotional communications reasonably necessary to respond to requests, provide requested services, or service an existing relationship.

5. Intellectual Property

The website and its original content, branding, logos, graphics, layout, text, and other materials are owned by or licensed to TLIA and are protected by applicable intellectual property laws. You may view and print website materials solely for your personal, noncommercial use in evaluating or obtaining services.

You may not reproduce, modify, distribute, publish, sell, license, create derivative works from, or commercially exploit website materials without prior written permission, except as permitted by law.

6. Insurance Carriers and Third-Party Services

Our website may provide access to or links for insurance carriers, benefit providers, scheduling platforms, enrollment systems, payment providers, and other third-party services. These parties operate independently and may maintain their own terms and privacy policies.

References to third-party products or services do not constitute a guarantee, warranty, or endorsement beyond TLIA's role as an insurance agency or service provider. We are not responsible for the availability, security, content, or practices of independently operated third-party websites or systems.

7. Electronic Communications and Records

When you communicate with us electronically, you consent to receive responses and records electronically where permitted. Electronic communications satisfy legal requirements that communications be in writing to the extent permitted by applicable law.

You are responsible for maintaining a valid email address and telephone number and for reviewing communications sent to the contact information you provide.

8. Website Availability and Disclaimers

We may modify, suspend, discontinue, or restrict any portion of the website at any time. We do not guarantee that the website will be uninterrupted, error-free, secure, or free from harmful components.

TLIA is not responsible for carrier underwriting decisions, eligibility determinations, premium changes, coverage limitations, claim decisions, enrollment deadlines, third-party system failures, or the terms and performance of products issued or administered by independent carriers or providers.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited. Your rights under applicable insurance and consumer protection laws remain unaffected.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to any rights or remedies that cannot be waived under applicable law, disputes relating to the website or these Terms will be brought in a court of competent jurisdiction located in Duval County, Florida.

11. Severability, Waiver, and Entire Agreement

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver of that provision or any other right.

These Terms and the documents expressly incorporated by reference constitute the agreement between you and TLIA regarding use of the website and related communications, without replacing the terms of any insurance policy, carrier contract, enrollment document, or other separately executed agreement.

12. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
