1. Scope of Services

Bold & Bolder LLC DBA THE LUGO INSURANCE AGENCY (“Agency,” “we,” “us,” “our”) provides insurance advisory, quoting, and policy placement services as an independent insurance agency appointed with one or more insurance carriers (“Carriers”). The Agency does not underwrite insurance policies, determine eligibility, or make binding coverage decisions. All approvals, declines, cancellations, renewals, policy changes, and claims decisions are made solely by the issuing Carrier.

2. Independent Agency Relationship

The Agency operates as an independent contractor and is not an employee, partner, joint venture, or fiduciary of any Carrier. The Agency’s authority is limited to marketing, quoting, submitting applications, and servicing policies as permitted under each Carrier appointment agreement.

3. Client Acknowledgements

By using Agency services, you acknowledge and agree that:

All insurance applications are subject to Carrier underwriting review and approval.

The Agency cannot guarantee the issuance, continuation, or renewal of any policy.

Premiums, rates, terms, policy forms, endorsements, and coverage limitations are determined by the Carrier, not the Agency.

A quote is not a guarantee of coverage or acceptance until confirmed in writing by the Carrier.

A Carrier may cancel, non-renew, modify, or discontinue a policy at any time in accordance with state law and Carrier policy provisions.

4. Authorization to Act

You authorize the Agency to:

Collect, review, and submit information to Carriers on your behalf

Communicate with you regarding quotes, applications, renewals, and service matters

Receive policy documents, notices, and billing information from Carriers when applicable

This authorization does not grant the Agency the authority to alter policy terms, waive Carrier rights, bind coverage without Carrier approval, or guarantee claim outcomes.

5. Fees, Commissions, and Compensation Disclosure

The Agency may receive commissions or other compensation from Carriers for the placement and servicing of policies. These commissions are paid by the Carrier and are not added as an extra charge to you unless expressly disclosed. If the Agency charges any separate service or broker fee, it will be disclosed in writing before being applied. You have the right to request information about the compensation received by the Agency.

6. Client Responsibilities

You agree to:

Provide true, accurate, and complete information when requested

Notify the Agency of changes that may affect your insurance needs or eligibility

Review all policy documents for accuracy and completeness

Pay premiums when due to avoid cancellation

Comply with all Carrier-required conditions for maintaining coverage

Failure to provide accurate information may result in denial, cancellation, or rescission of coverage by the Carrier.

7. No Guarantee of Coverage or Claims Approval

The Agency does not guarantee:

That a Carrier will accept an application

That coverage will remain in force indefinitely

That a claim will be approved or paid

That premiums, terms, or product offerings will remain unchanged

All insurance products are subject to the Carrier’s underwriting guidelines, policy terms, and legal requirements.

8. Privacy and Data Handling

The Agency collects and uses personal information in accordance with its Privacy Policy. By submitting information to the Agency, you consent to its use for insurance quoting, servicing, and compliance purposes. You may review the Agency’s Privacy Policy at any time.

9. Limitation of Liability

To the fullest extent permitted by law, the Agency’s total liability for any claim relating to its services shall not exceed the amount of commissions or fees received by the Agency for the policy involved. The Agency shall not be liable for indirect, incidental, punitive, or consequential damages, including but not limited to loss of coverage, denied claims, product discontinuation, or Carrier decisions outside the Agency’s control.

10. Termination of Relationship

Either party may terminate the relationship at any time by written notice. Termination does not modify any obligations related to unpaid premiums, earned commissions, or Carrier-issued policy provisions. If the Agency’s appointment with a Carrier ends, the Agency may assist with transferring the policy, but is not obligated to provide ongoing service for that Carrier.

11. Governing Law

These Terms are governed by the laws of the State of Florida. Any legal action arising under these Terms will be brought exclusively in the state or federal courts located in the State of Florida. You consent to the jurisdiction of those courts.

12. Amendments

The Agency may revise these Terms of Service at any time by updating the effective date and posting the revised version on its website. Continued use of Agency services constitutes acceptance of the updated Terms.

13. Entire Agreement and Severability

These Terms, together with the Privacy Policy and any required Carrier disclosures, constitute the full agreement between you and the Agency regarding the use of Agency services. If any provision is held invalid, the remaining provisions shall remain in full force and effect.
